Part 1: Service Agreement

Welcome to use the services provided by Jinkai Zhu!

Special Reminder: By starting to use the Shotts services, you signify that you have read and decided to accept the "Shotts Service Agreement" ("this Agreement"). If you have any questions regarding this Agreement, or cannot accept all or part of it, or need to give feedback (including suggestions, complaints, reports, etc.) to Jinkai Zhu while using Shotts, please contact Jinkai Zhu without hesitation at the following email address: naiso.limbo@outlook.com.

1. This Agreement and Definitions:

This Agreement is made between you and Jinkai Zhu about your use of the relevant Shotts services. Based on factors like business, applicable laws, and policies, Jinkai Zhu may update this Agreement at any time. If you can't accept this Agreement or any part of its future updated versions, contact Jinkai Zhu. Please stop using Shotts until you reach an agreement with Jinkai Zhu.

Shotts is an application software product developed, operated, and managed by Jinkai Zhu. It offers you a free, non-exclusive software use license and technical services globally within the scope of this Agreement. Depending on the context, "Shotts" here may refer to the Shotts mobile app, Shotts mini-program, Shotts independent website, or the related technical services provided by Jinkai Zhu around the Shotts software product.

When it comes to the rights Jinkai Zhu can enjoy according to this Agreement, the "Jinkai Zhu" mentioned in this Agreement refers to an individual developer.

Materials refer to the relevant materials and information, such as audio, fonts, text, instructions, animations, etc., that are already built into or will be added to Shotts in the future, provided by Jinkai Zhu to assist you.

2. Intellectual Property Rights Statement:

All intellectual property rights of Shotts, including all versions, technologies, programs, materials, and all information content (like product functions, user interfaces, operation steps, trademarks, patents, computer software works), belong to Jinkai Zhu. Jinkai Zhu's software use license to you should never be regarded as a partial or full transfer of Shotts' intellectual property rights. Any materials and other information content you download and use via Shotts are only for your personal entertainment, study, research, training, or appreciation. Without Jinkai Zhu's written consent, they cannot be used for commercial purposes.

3. Your Necessary Authorization:

You agree to grant Jinkai Zhu a free, non-exclusive, and irrevocable right to use the information content generated during your use of this service globally. This is for the purposes of providing, optimizing, and promoting this service. Jinkai Zhu will do its best to use the above information content within a reasonable range, and your authorization doesn't mean Jinkai Zhu will definitely use it.

4. Personal Information Protection:

Protecting your personal information is a fundamental principle for Jinkai Zhu. Jinkai Zhu will collect, use, store, and manage your personal information according to the provisions of this Agreement.

5. Your Lawful Use:

You must not use Shotts to create, store, or publish information that endangers national and social security. This may include, but isn't limited to, opposing the basic principles of the Constitution; endangering national security, disclosing state secrets, subverting state power, and undermining national unity; inciting ethnic hatred and discrimination and breaking ethnic unity; undermining state religious policies, promoting cults and feudal superstitions; spreading rumors, disturbing social order, and undermining social stability; promoting gambling, violence, homicide, terror, or abetting crimes; inciting illegal assemblies, associations, parades, demonstrations, and gatherings to disrupt social order; containing other content prohibited by laws, administrative regulations, and national regulations.

Do not use it to handle obscene and pornographic information. This includes, but isn't limited to, publishing content like soliciting prostitution, seeking one-night stands, sexual partners, etc.; publishing erotic text, videos, and pictures for pornographic purposes; regularly publishing content that's on the verge of or has sexual implications related to obscene and pornographic content.

Avoid creating, publishing, and storing infringing information, such as content that violates the legitimate rights of others, like the right to reputation, the right to portrait, the right to privacy, and intellectual property rights.

Refrain from using Shotts for unfair competition information, for example, publishing content with tampered, added, or deleted rights marks; publishing content without authorization from the authorized party.

Also, don't use it to spread other information that violates laws, regulations, policies, and social ethics, or disrupts the normal operation of Shotts and infringes on the legitimate rights and interests of any third party.

If you engage in any of the above illegal acts or acts that violate others' legitimate rights, Jinkai Zhu has the right to take immediate and appropriate measures, like deleting such illegal information content, terminating your software use license and stopping all technical services, and turning to law enforcement agencies or judicial organs. If you cause losses to yourself or damage to Jinkai Zhu and/or third parties due to improper use of Shotts, you are responsible for all losses.

6. Advertising Business License:

Shotts may contain advertisements, which is a reasonable and legal business model for Jinkai Zhu. You agree to receive advertising information from Jinkai Zhu and its third-party partners when using Shotts.

7. Force Majeure and Other Exemption Reasons:

The use of Shotts can be affected by force majeure or other factors, including political reasons, social environment, natural disasters, economic crises, computer viruses or hacker attacks, server or system instability, your special location, any technical capabilities, network quality, communication lines, computer failures, etc. (collectively referred to as "exemption reasons"). In case of such reasons, Jinkai Zhu will try to repair or remedy promptly. To the extent permitted by applicable laws and policies, Jinkai Zhu is exempt from liability for losses caused to you.

8. Applicable Laws and Policies:

Matters related to this Agreement are governed by the laws and policies of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan regions). These laws and policies may change. So, if changes lead to an increase or decrease in the rights and interests of you and/or Jinkai Zhu under this Agreement, it doesn't automatically make the entire Agreement or a certain clause invalid or unenforceable, unless the changed laws and policies are mandatory provisions of effectiveness.

9. Jurisdiction of Legal Disputes:

If there are legal disputes between you and Jinkai Zhu regarding this Agreement and/or Shotts, as long as the applicable laws and policies at the time of the dispute allow Jinkai Zhu's location to be the sole or one of the dispute jurisdiction places, you agree that the people's court with jurisdiction in Jinkai Zhu's location has exclusive jurisdiction over the dispute.

Part 2: Privacy Policy

We highly value your privacy.

Jinkai Zhu is committed to protecting users' privacy. This privacy policy explains how we collect, store, use, and manage information when you use our services. This information includes personal information you provide to us or relevant information we collect through our website or mobile application terminals. The main collection channels are the Jinkai Zhu application products on mobile devices (such as Apple devices and Android devices), which we call "our services".

Using our services means you agree to this policy and the collection and processing of your data (including personal information) as stipulated. If you don't agree to any terms of this policy or its future revised versions, please don't use the services.

Information We May Collect

To offer you better services, we'll collect relevant data and information from you within the legal scope and only when you use certain functions or services.

Information You Provide to Us

When using our services, we may suggest you register an account to fully enjoy our services. When registering, we'll collect identifying information like your account name and mobile phone number, which are necessary for account registration.

Information We Obtain When You Use the Services

Device Information

When you use any Jinkai Zhu application on a mobile platform, we may collect and record information such as your product unique identity (continuous/intermittent), hardware type, Media Access Control ("MAC") address, International Mobile Equipment Identity ("IMEI"), your operating system ("OS") version, the name of your device, and your location (based on your Internet Protocol ("IP") address, SIM card country code, GPS). This information helps us solve problems and understand overall user usage trends.

We may collect your location information to provide you with the correct application version and higher-quality services. Unless stated otherwise in this policy, we won't share this information with third parties. If you don't want us to track or use this information, you can turn off the network, GPS function on your device, or disable our permission to obtain this information.

Also, we may create a unique user identity to track your service usage. This identity is stored with your personal profile information to help us understand which Jinkai Zhu application you're using.

Usage Logs

When you use our services, including participating in, generating, and browsing related content, we'll automatically collect relevant log information within the Jinkai Zhu application. This includes details like your usage time, frequency, and purchase records, as well as device statistics, key operation paths, error logs, crash records, language, and time zone. These logs help us improve services and aren't used to identify specific individuals.

Advertising

We may introduce partners to show advertisements in our services, but we won't share your personally identifiable information with them. Instead, we'll provide partners with indirect portraits that can't identify you personally, along with de-identified or anonymized device, network, and channel information, to help them improve advertisement reach without identifying individuals.

Information Collected by Third Parties

Our services may include third-party tracking tools from our service providers. These third parties may use cookies, APIs (Application Programming Interfaces), and SDKs (Software Development kits) to collect and analyze user information on our behalf. They may access information like your device identifier, MAC address, IMEI, region, geographical location information, and IP address, to provide services according to their privacy policies. We collect user information to improve service quality and user experience. For this purpose, we may use your information for:

Information Security

We take reasonable measures to prevent information loss, improper use, unauthorized access, or disclosure. For example, in some services, we use encryption technology to protect your personal information. However, in the Internet industry, even with our best efforts, we can't always guarantee 100% information security. You should know that the system and communication network you use to access our services may have problems beyond our control.

Information Access and Control

We'll use appropriate technical means to ensure you can access, update, and correct your registration information or other personal information provided during service use. When accessing, updating, correcting, or deleting this information, we may require you to authenticate your identity to ensure account security.

Data Retention

Subject to legal requirements, we'll retain your information within the time range of "How We Use the Information" or the period during which we provide services for you. If you want to delete your account or request that we stop using your information to provide services, please email naiso.limbo@outlook.com.

Children's Information

We won't intentionally collect or request personal information from people under 13 years old. If you're under 13, please don't send us your personal information, including your name, address, phone number, or email address. Applicable Laws and Dispute Resolution

This policy, including its conclusion, validity, interpretation, performance, and dispute resolution, is governed by the laws and policies of the People's Republic of China (excluding Hong Kong, Macao, and Taiwan regions). You agree that we'll update this policy according to laws, regulations, or Jinkai Zhu's commercial decisions, and you're bound by the revised policy. For major changes, we'll issue an announcement when necessary. We suggest you check our announcements regularly.
